ACKNOWLEDGMENT OF RISKS

I, the undersigned participant, acknowledge and understand that:

1. INHERENT RISKS OF MOTORCYCLE RIDING

Participating in motorcycle adventures organized by PT Ninety Nine Riding ("99 Riding Co") involves inherent risks including but not limited to:

  • Accidents and Collisions: Risk of collision with other vehicles, pedestrians, animals, or stationary objects
  • Road Conditions: Uneven surfaces, potholes, gravel, mud, rain, and unpredictable terrain
  • Weather: Rain, wind, heat, and other weather conditions that may impair visibility or control
  • Mechanical Failure: Possibility of motorcycle malfunction despite regular maintenance
  • Physical Injury: Risk of serious injury including fractures, head trauma, paralysis, or death
  • Remote Locations: Limited access to immediate medical care in rural or remote areas
  • Traffic: Driving customs and traffic patterns different from my home country

I voluntarily assume all risks associated with this activity, both known and unknown.

2. PARTICIPANT RESPONSIBILITIES

I confirm that:

  • I am at least 18 years old
  • I hold a valid motorcycle license and International Driving Permit (IDP)
  • I have personal travel and medical insurance covering motorcycle riding (125cc+) abroad
  • I am in good physical and mental health and capable of riding a motorcycle for extended periods
  • I have disclosed any medical conditions that may affect my ability to participate safely
  • I will follow all safety instructions provided by 99 Riding Co guides
  • I will ride responsibly and within my skill level
  • I will not ride under the influence of alcohol or drugs
  • I will wear provided safety equipment (helmet) at all times while riding

3. MOTORCYCLE INSURANCE & DAMAGE LIABILITY

I understand that:

Insurance Coverage:

  • Motorcycles are insured by PT. ASURANSI BINA DANA ARTA Tbk (OONA)
  • Coverage applies to total loss only (theft or complete destruction)
  • Partial damage is NOT covered (scratches, dents, broken parts, mechanical damage from misuse)

Financial Responsibility:

  • I am fully responsible for any damage to the motorcycle beyond total loss
  • I will pay for repairs or replacement of damaged parts immediately or within an agreed timeframe
  • Damage costs will be assessed fairly and transparently
  • 99 Riding Co reserves the right to withhold my deposit or charge my payment method for damages

Examples of Participant Liability:

  • Dropping the motorcycle (scratches, broken mirrors, damaged fairings)
  • Mechanical damage from improper use (burnt clutch, damaged engine from poor riding)
  • Lost or stolen accessories (if due to participant negligence)

4. RELEASE OF LIABILITY

To the fullest extent permitted by Indonesian law, I hereby release, waive, discharge, and hold harmless:

PT Ninety Nine Riding, its owners, employees, guides, contractors, and partners from any and all liability, claims, demands, actions, or causes of action arising from:

  • Personal injury, death, or property damage
  • Medical expenses or costs incurred
  • Motorcycle accidents or mechanical failures
  • Decisions made by guides regarding routes or safety
  • Acts or omissions of other participants
  • Weather conditions or force majeure events

This release applies even if injury or damage results from negligence (except gross negligence or intentional misconduct).

5. MEDICAL AUTHORIZATION

In case of injury or medical emergency:

  • I authorize 99 Riding Co to arrange medical treatment on my behalf
  • I understand that I am financially responsible for all medical costs
  • I will provide accurate information about allergies, medical conditions, and medications
  • I consent to the sharing of medical information with healthcare providers as necessary

6. PHOTOGRAPHY & MEDIA RELEASE

I grant 99 Riding Co permission to:

  • Photograph and video record me during the trip
  • Use images and videos for marketing, social media, and promotional purposes
  • Publish testimonials or reviews I provide

7. COMPLIANCE WITH LAWS

I agree to:

  • Comply with all Indonesian traffic laws and regulations
  • Respect local customs and communities
  • Follow environmental protection guidelines (stay on designated routes, no littering)

8. PARTICIPANT CONDUCT

I understand that 99 Riding Co reserves the right to:

  • Terminate my participation without refund if I:
    • Engage in reckless or dangerous riding
    • Disregard safety instructions
    • Endanger myself or others
    • Violate local laws
    • Display disruptive or inappropriate behavior

9. ACKNOWLEDGMENT OF UNDERSTANDING

By signing below, I confirm that:

  • I have read and fully understand this Liability Waiver
  • I have had the opportunity to ask questions and seek legal advice
  • I am signing this document voluntarily and without coercion
  • I understand that this is a legal contract that limits my ability to sue
  • I agree to all terms and conditions outlined in this waiver
